1. Payment, Licensing, and Service Completion

• Payment is due for services rendered.
• Full payment is due prior to delivery of media.
• Delivery of a proof gallery or final gallery constitutes completion of the service.
• Completion of service is not dependent on whether the client downloads, licenses, uses, or publishes the media.
• Services are non-refundable once the appointment has been completed and media has been delivered.
• Panhandle Productions retains full copyright ownership of all media.
• Clients purchase a license to use the media, not ownership.
• Licensing rights are granted only upon full payment.
• Declining to use, download, or license the media does not void payment obligations.

2. Licensing Scope, Permitted Use, and Restrictions

Standard License

The standard license permits use of the media for marketing purposes, including:
• MLS listings
• Vacation rental platforms (Airbnb, VRBO, Booking.com)
• Company or personal websites
• Social media, email marketing, and digital advertising
• Print marketing materials

The license is issued to the original client or company that placed the order and is not tied to the property itself.

Restrictions

Unless expressly authorized in writing by Panhandle Productions, the following are prohibited:
• Resale, redistribution, or transfer to third parties
• Use by builders, designers, stagers, or unrelated parties
• Unrelated commercial, stock, merchandise, or template use
• Removal of metadata, authorship, or copyright notices
• Public distribution of full-resolution downloadable files

3. License Transfers

• Media licenses are not transferable by default.
• If a listing changes agents, brokerages, ownership, or management companies, a license transfer fee is required.
• Transfer fees are determined by media type and scope and must be paid prior to use by the new party.
• License transfer fees do not include edits, revisions, reshoots, or additional deliverables.

4. Editing, Alterations, and AI Usage

• Clients may not re-edit, alter, manipulate, or modify delivered photos or videos without prior written permission from Panhandle Productions, except for basic resizing or cropping for placement.
• Heavy editing, color manipulation, object removal/addition, compositing, or stylistic changes are not permitted without authorization.
• Media may not be uploaded to, processed by, or used with artificial intelligence tools or services, including but not limited to AI enhancement, AI editing, AI training, generative AI models, or machine-learning datasets.
• Unauthorized editing or AI usage constitutes a material breach of this agreement and may result in license revocation and enforcement action.

5. Reshoots, Revisions, and Additional Services

• Reshoots, revised angles, additional coverage, or new deliverables requested after delivery are considered new services and billed separately.
• Requests based on décor changes, furniture changes, renovations, seasonal updates, or personal preference are not included in the original service.
• Dissatisfaction with marketing performance or subjective appearance does not qualify for complimentary reshoots.
• Video services include one revision unless otherwise stated. Additional revisions are billed at published rates.

6. Reshoots Not Attributable to Panhandle Productions

Reshoots caused by factors outside the control of Panhandle Productions are considered new services, including but not limited to:
• Properties not being photo or video ready
• Locked or inaccessible areas
• Occupants present or personal items visible
• Incorrect or incomplete booking information
• Weather conditions affecting exterior or aerial coverage
• Changes made to the property after the original appointment

7. No Guarantee of Marketing Performance

Panhandle Productions does not guarantee sales results, rental performance, booking volume, lead generation, or marketing outcomes. All media is provided for promotional use only.

8. Cancellations, Rescheduling, and Weather

• Cancellations are permitted up to 24 hours before the scheduled appointment.
• Cancellations within 24 hours may result in a cancellation fee.
• Rescheduling is permitted up to 8 hours before the appointment.
• Drone services cannot be performed in rain, fog, or hazardous wind conditions.
• Weather-related rescheduling is permitted at the client’s discretion within the stated window.

9. Appointment Requests and Property Readiness

• Properties must be photo and video ready at the scheduled appointment time.
• Clients are responsible for coordinating access with owners, tenants, builders, or managers.
• Properties not ready may incur a rescheduling fee.
• Panhandle Productions does not move large or delicate items.

10. Turnaround Time, Delivery, and Archiving

• Photography is typically delivered next business day.
• Most video projects are delivered next business day; however, certain video projects may require 3–5 business days depending on scope and complexity.
• Clients are responsible for downloading and storing delivered files.
• Panhandle Productions does not guarantee long-term archiving beyond 1 year unless otherwise agreed in writing.

11. Travel and Additional Square Footage

• A 30-mile service radius from Panama City Beach, Florida is included.
• Additional travel and square footage fees apply per published pricing and reflect additional time and operational costs.

12. Non-Payment and Enforcement

• Failure to remit payment constitutes a breach of this agreement.
• Panhandle Productions reserves the right to revoke licensing rights, restrict access to delivered media, and pursue collection of outstanding balances.
• The client agrees to be responsible for all reasonable costs of collection, including administrative fees, collection agency fees, court costs, and reasonable attorney fees, where permitted by law.
• Late payments may incur published late fees.

13. Right to Refuse or Discontinue Service

Panhandle Productions reserves the right to refuse or discontinue services due to non-payment, repeated violations of these terms, abusive or inappropriate behavior, safety concerns, or misuse of licensed media. The client remains responsible for payment for any services already rendered.

14. Technical Support and Third-Party Platforms

• Panhandle Productions is not a technical support provider.
• We do not provide assistance with MLS uploads, vacation rental platforms, third-party software, file compatibility, device issues, or download troubleshooting.
• Clients are responsible for understanding and complying with platform requirements and technical limitations.

15. Occupied Properties and Privacy

Clients are responsible for removing personal or confidential items prior to the appointment. Panhandle Productions is not responsible for the visibility of such items in delivered media.

16. Virtual Staging and Digital Edits

Virtual staging, sky replacement, grass replacement, and other digital edits are provided for marketing purposes only and are not factual representations of the property.

17. Drone and FAA Compliance

All aerial services comply with FAA regulations. Certain locations or conditions may prohibit drone operations.

18. Property Owner Approval

Clients are responsible for obtaining any required property owner approvals prior to filming or photography.

19. Client Responsibility for Platform Rules

Clients are responsible for compliance with MLS, Airbnb, VRBO, Booking.com, and other platform-specific rules and requirements.

20. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Summary

These Terms of Service define service completion, payment obligations, licensing rights, editing restrictions, AI limitations, transfers, reshoots, and client responsibilities. Booking with Panhandle Productions constitutes full acceptance of these terms.
